The plaintiff Anthony N. Wood, in the above-entitled actions, here moves for an order apportioning legal fees and expenses pursuant to subdivision 1 of section 29 of the Workers’ Compensation Law.
On July 14, 1978, Anthony N. Wood sustained a severe and permanent injury while an employee of the Town of Stillwater Highway Department. Plaintiff Anthony N. Wood brought an action against the Firestone Tire and Rubber Company who, as third-party plaintiffs, brought *813the Town of Stillwater into the action.
