Pinkston brought his petition against Guilford, sheriff, Harrell, former sheriff, and C. G. Mercer, alleging that J. W. Mercer had obtained a judgment against him for four *103hundred dollars principal, with interest from February 21, 1890, at 7 per cent, per annum, and that the execution issued on such judgment was controlled by C. G. Mercer; that Harrell as sheriff had levied such execution upon an undivided one-half interest in lot of land 128 in the 8th district of Quit-man county, and that the same was sold to C. G.
