The superior court made a conditional order, granting the writ if the commissioners erred as matter of law in making an order discontinuing “ that part of Ferry street between the easterly line of the right of way of the Concord & Montreal Railroad and the westerly line of the right of way of the Concord & Claremont Railroad.” Ferry street is an ancient highway, and the portion discontinued is about 320 feet in length and is now ■crossed at grade by the right of way and tracks of the Concord & Claremont, the Northern, and the Concord & Montreal railroads.
