Exception is taken to the refusal to issue a rule nisi on a motion to set aside a judgment. Plaintiffs in error were sureties on a criminal bond for the appearance of the defendant for trial. Upon his failure to answer to the charge on the call of the case at the May term, 1922, of Glynn superior court, the usual rule nisi was issued and the bondsmen were served. TJpon the call of the case at the following term, counsel for the defendant made a showing for continuance, based on the alleged inability of the defendant to attend the trial, on account of illness; to which a counter-showing was…
