CHRISTIAN, Judge.

The offense is manufacturing intoxicating liquor; the punishment confinement in the penitentiary for one year.

Appellant’s witness, Lonnie Bell,, would have given testimony material to appellant’s defense. The state objected to the testimony of the witness on the ground that he was under indictment for the same offense for which appellant was being tried. The court sustained the objection without hearing any testimony on the question, nor was there any admission or agreement that the witness was so indicted.
