Affirming.

■ In this action to recover damages for personal injuries resulting in the death of J. H. Sinclair, the trial court on the conclusion of the evidence for the plaintiff directed the jury to return a verdict for the defendant. The appellant, who was the plaintiff below, insists that the case should have gone to the jury. So that the only question we need consider is the correctness of the ruling of tire trial court in taking the case from the jury.
