KEY, Chief Justice.

This is an action of debt, founded upon a dormant judgment, and from a recovery in favor of the plaintiff the defendant has appealed. The trial court filed the following findings of fact and conclusions of law:

"Findings of fact.—I. I find that Pyke Burnett, the plaintiff in this suit, on the 6tli day of January, 1900, filed suit against H. B. Easterwood & Co. in the Justice’s Court of precinct No. 2 of Bobertson County, Texas, and that citation was issued in said suit on the same day; that on the 15th day of February, 1900, plaintiff recovered a judgment in said suit…
