(dissenting) — This action was brought by plaintiff against defendant corporation to recover for property damage and for personal injuries sustained by plaintiff as a result of the collision of his automobile with the rear end of a truck, owned and operated by defendant, on the Stevens Pass highway a short distance east of Everett.
