Kenneth Hemphill (“Hemphill”) appeals the trial court’s judgment entered in favor of Joseph Pollina (“Pollina”). Hemphill argues that the trial court erred in excluding two pieces of evidence, Pollina’s custodial silence and Pollina’s Alford plea to the charge of assault in the second degree. Hemphill also claims that the trial court erred in submitting a self-defense instruction to the jury because there was not substantial evidence in the record to support a finding that Pollina was in apprehension of imminent danger of death or great bodily harm or that deadly…
