A suit was commenced to have certain written transfers of property, real and personal, declared invalid, and to have a trust imposed on such real and personal property in plaintiff Marjorie K. King’s favor for an undivided one-half interest therein. Consolidated therewith was a proceeding commenced in probate court to construe a joint, mutual and contractual will which was in due time certified to the district court.
