This is an action to recover damages brought under the Federal Employers’ Liability Act. 45 U.S.C.A. Sec. 51 et seq. The particular section of the Act with which we are principally concerned is Section 53. Judgment in favor of plaintiff, based primarily on a jury verdict entered by the trial court, was affirmed by the Court of Civil Appeals. 297 S.W. 2d 247. This court granted a writ of error on a petition which asserted four points of error.
