This matter comes before the Court on appeal on questions of law from a judgment of the Municipal Court of Co lumbus, Ohio, wherein the .defendant was convicted of violating the provisions of Section 1089-1 of’ the city ordinances of Columbus, Ohio. The ordinance provides as follows:
