This is a proceeding to probate a will hereafter set out, brought by the prime beneficiary thereof against certain heirs and representatives of the testator., One of the testator’s nephews opposed the probate of the so-called will. He answered the petition filed in the County Court denying the validity of the will and prayed that his answer be treated as a petition for contest and that the cause be transferred to the Circuit Court to be there tried upon an issue of devisavit vel non. None of the other defendants answered and a pro confesso was taken against them.
