Pickering v. People
Supreme Court of The Virgin Islands
1Opinion of the Court
OPINION OF THE COURT
(February 25, 2016)
Hodge, Chief Justice.
Appellant As wad Pickering commenced this appeal from the Superior Court’s February 10, 2015 order, which denied his motion to dismiss two counts of a felony information pending against him under the Double Jeopardy Clause of the Fifth Amendment of the United States Constitution. Because Pickering has now abandoned his request to have these charges dismissed, and he will face re-trial *358regardless of the outcome of this appeal, we dismiss his appeal for lack of jurisdiction.
