JOHNSON, Judge.

This action arises from the construction of a Comfort Inn motel in Garner, North Carolina on land owned by defendant, Gunatit Corporation. Although the deed shows the land to be in the name of Gunatit, Inc., 903 Hampshire Court, Cary, North Carolina 27611, both the contract between the owner and general contractor, R.P. Construction Company, Inc., and the general contractor and the subcontractor, Hartland Construction Co., show the owner of the property as Gunatit Corporation, 903 Hampshire Court, Cary, North Carolina 27511.
