Mason, Judge :

The defendant, the Charleston National Bank, is a corporation, doing business in the city of Charleston, W. Va., as a National Bank, organized under the Acts of Congress, and operating a savings department in connection with its other-banking business. It adopted certain rules and regulations *623for the government and control of its savings department. The rules involved in this suit are as follows:

Rule 3. “As it will be necessary to loan out the funds of the bank in order to pay interest, depositors may be required to give sixty days notice before withdrawing their deposits, but…
