MEMORANDUM OPINION
JOHNSTONE, Chief Judge.
This admiralty action for cargo damage is before the Court on the parties’ cross-motions for summary judgment pursuant to Fed.R.Civ.P. 56. The parties agree that the action is governed by the Carriage of Goods by Sea Act (COGSA), 46 U.S.C. Appx. §§ 1300-1315, and that the Court has jurisdiction by virtue of 28 U.S.C. §§ 1331 & 1333.
