The defendants in error were plaintiffs in the trial court, the plaintiffs in error were defendants there, and the parties will be so designated here. Dorothy Louise and Alma Frances Schulz, minors, brought this suit by Kate Smith, their guardian and nest friend, against Freeman and Boettcher, as receivers of the Denver & Salt Lake Railroad Company, to recover damages for the death of their parents, Robert Schulz and Alvina Schulz, caused by the alleged negligence of defendants.
