This is an application for writ of error from the Court of Civil Appeals for the Second District at Fort Worth, Texas.

It appears from the record before us that on July 8, 1931, Mrs. Burguieres, plaintiff in error here, filed suit in the District Court of Tarrant County, Texas, against John E.
