Defendant, indicted for murder, was convicted of manslaughter and sentenced to five years at hard labor and to pay a fine of fifty dollars.

He appeals.

In the only bill of exceptions taken during the trial it is set forth that the accused offered to prove the dangerous character of the man who was killed, and that this offer was made after it was established, (1) that the deceased had, during the quarrel, transferred his pistol from the left belt of his pants to his right hand breeches pocket; (2) that he had cursed the accused after the…
