OPINION

BUSSEY, Judge:

Appellant, Joe Dean Burney, hereinafter referred to as defendant, was charged, tried and convicted in the District Court, Okfusk-ee County, Case No. CRF — 76-6, with the offense of Attempted Larceny of a Domestic Animal, After Former Conviction of a Felony, in violation of 21 O.S.1971, § 1716. His punishment was fixed at five (5) years’ imprisonment. From said judgment and sentence a timely appeal has been perfected to this Court.

A summary of the testimony reflects that on February 13,1976, at approximately 6:00 p. m., Robert Williams was in his yard working on his pickup…
