BEAUCHAMP, Judge.
The conviction is upon an indictment charging rape of a female not his wife, who is under the age of fifteen years. The penalty assessed is death.
The appellant is a married man, was twenty-seven years of age at the time of the trial, and had one child, a girl twenty months old. He testified in his own behalf, identifying himself as the proper party, and admitting sexual intercourse with the prosecutrix on the date alleged.
