Appellant, W. P. Sanders, was indicted and convicted in the circuit court of Sunflower county, under section 1141, Code of 1906 (Hemingway’s Code, section 869), of embezzling', while superintendent of education of Sun-flowed county, seventeen thousand five hundred, sixty-seven dollars and sixty-three cents of the funds belonging to said county, and was sentenced to the penitentiary for a term of five years, from which judgment he prosecutes this appeal.
