The accused was convicted of subornation of perjury and sentenced to one year in jail and to pay a fine of $500.

A brief statement of the facts is essential to a clear understanding of the application of the principles involved in the numerous assignments of error.

The accused, who operates a tea room near Alleghany Station, at the April term, 1932, of the Circuit Court of Alleghany county, was tried for selling whiskey to one J. H. Ricketts. He, and others, testified that he bought *1054whiskey from the accused about eight o’clock on the evening of December 10, 1931.
