Appellant was indicted at the April term, .1912, of the Allen Circuit Court charged with the murder of W. B. Roark, and upon his trial was convicted of manslaughter, and sentenced to' the penitentiary.
In his motion and grounds for a new trial, he relies upon three alleged errors:(1) That the court erred to his prejudice in refusing-after the regular panel of the jury had been exhausted to draw from the drum or wheel case a sufficient number of names to complete the jury; but on the contrary directed the sheriff to summon a sufficient number of…
