On April 20, 2009, Plaintiffs and Defendants E.I. DuPont de Nemours and Company (“DuPont”) and DuPont Performance Elastomers, L.L.C. (“DPE”) (collectively herein, “Defendants”) (hereinafter the Plaintiffs and Defendants are collectively referred to as “Parties”), appeared for a Fairness Hearing on their Joint Motion for Preliminary Approval of Class Action (the “Joint Motion”).
