MONROE, J.
Plaintiff and the defendant Sellers were opposing candidates for nomination to the office of .sheriff and tax collector of the parish of St. Charles, at the primary election held under the direction of the Democratic executive committee of the parish, on the 28th of January last past. The returns of the election were made by the commissioners to the chairman of the committee, and, on the third day after the primary (January 31st), the committee reconvened for the purpose of considering the tabulated and compiled statement, then to be submitted to them, and of…
