On December 3, 1958, William Fountain filed with the Industrial Commission an application for adjustment of claim against Republic Steel Corporation, alleging that on March 26, 1958, he was injured by reason of an accident arising out of and in the course of his employment in that he sustained a heart attack while at work. At the hearing before an arbitrator it was stipulated that on March 26, 1958, both parties were operating under the provisions of the Illinois Workmen’s Compensation Act, and the relationship of employer and employee existed between the parties on that date.
