This is an appeal from a conviction of appellant under an indictment which in good form charged him with the crime of seduction alleged to have been committed against the person of one Clytie Du-Priest. The appellant was indicted on the 19th day of July, 1921. On the 26th day of July, 1921, he filed a motion for a continuance in which he set up that he could not safely go to trial at that term of the court- on account of the absence of Jewell Moon, Lloyd Casteel and Déwey Wilkerson.
