Action op Contract in which the Director General of Railroads was summoned as trustee. Trial by Court at the September Term, 1919, Washington County, Butter, J., presiding. Judgment for the plaintiff against the principal defendant and the trustee. The trustee excepted. The opinion states the ease.

Before the service of the writ in this case, the United States Railroad Administration, in charge of the Director General of Railroads, was indebted to the defendant, Raymond Cutting, on claims for loss of freight and freight overcharges aggregating $1,691.52, which accrued about March 1, 1918, and had become liquidated at the time of service. The plaintiff summoned the Director General of Railroads as trustee. The suit having been discontinued as to all of the defendants except Raymond Cutting, the plaintiff had judgment against him as principal defendant. On the question of the trustee’s…
