The plaintiff (appellee) Walter Shufelberger brought this action against Jim Worden, sometimes known as W. A. Worden, defendant (appellant), to recover for personal injuries sustained, by reason of the alleged negligence of the defendant. The allegations of the pleadings will not be narrated. Suffice it to say that plaintiff charged defendant with negligence in certain specified particulars. Defendant answered, charging plaintiff with contributory negligence and assumption of risk.
