Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court at Special Term, entered in Albany County) to review a determination of the Public Employment Relations Board, which found that petitioner had violated section 209-a (subd 1, pars [a], [d]) of the Civil Service Law. On November 14, 1974 the Albany Police Officers Union filed an improper practice charge against the City of Albany, alleging that the city’s police department had instituted a new tardiness rule which violated each paragraph of subdivision 1 of section 209-a of the Civil Service Law.
