POWELL, Judge.
Plaintiff in Error, Dink W. Templeton,, hereinafter referred to as defendant, was charged by information filed in the Court of Common Pleas of Tulsa County with the-crime of operating a motor vehicle over and upon a public highway in the county of’ Tulsa, while under the influence of intoxicating liquor; was tried before a jury, con victed, and his punishment fixed at a fine of $100.
For reversal two propositions are advanced which will be considered in the order presented, after a summary of the evidence.
