MEMORANDUM AND ORDER

WEXLER, District Judge.

Plaintiffs Mina Breslow and Ronald Bres-low (the “Plaintiffs”) commenced this action to recover damages for injuries suffered when Mina Breslow fell while boarding the Motor Yacht “Pelican,” owned by defendant Mark Schlesinger. Ronald Breslow, plaintiff Mina Breslow’s husband, sues for loss of consortium. Plaintiffs allege that the defendants were involved with obtaining and/or placing a gangplank-like apparatus between the dock and the boat, from which the plaintiff Mina Breslow fell.
