KRUEGER, Judge.

The conviction is for the offense of burglary of a private residence at night with the intent to commit rape. The punishment assessed is confinement in the State penitentiary for a term of five years.

It appears from the record that at the April term, 1941, of the District Court in and for Brooks County, the grand jury of said county returned an indictment against the appellant which contained four counts, the first of which" charged him with burglary with intent to commit theft, the second charged him with burglary with intent to commit rape on a female under the age of…
