We are of the opinion that the warrant of attachment in this case was improperly granted. The grounds of its allowance was that the defendant was disposing of, or was about to assign and dispose of his property with intent to defraud his creditors. These grounds are sought to be supported by threats alleged to have been a made by him that if sued he would make a preferential assignment of his property, in which case those prosecuting him would get nothing on their claims.
