The plaintiff in error, hereinafter called defendant, was convicted of transporting intoxicating liquor and was sentenced to pay a fine of $50 and to be imprisoned in the county jail for 30 days.

The testimony, in substance, on the part of the state, is that the sheriff and two> other officers of Kiowa county were driving on the streets of the city of Hobart and saw the defendant come out of an alley, watched him cross and recross a street.
