A. Procedural Posture

Frank Lucchesi (the “Plaintiff’) filed his initial complaint in this case on April 15, 2003. The complaint vaguely alleged violations of the Fair Credit Reporting Act (“FCRA”), 15 U.S.C. § 1681 et seq., by Experian Information Solutions, Inc. (the “Defendant”). In an order dated July 7, 2003, Judge Kaplan granted the Defendant’s motion to dismiss, finding that the Plaintiff, the alleged owner of a business, had no claim under the FCRA. See Lucchesi v.
