On March 6, 1987, The University of Tennessee [“UT”] filed this action in the Circuit Court for Knox County, Tennessee, at Knoxville [“Circuit Court”] against a surety, * United States Fidelity & Guaranty Company [“USF & G”], in connection with construction of the Assembly Center and Arena [“the Arena”] on the campus of UT.
