OWENS, Chief Judge.
Before the court is plaintiffs motion for an award of attorney fees brought pursuant to 42 U.S.C. § 1988. After careful consideration of the arguments of counsel, the factors relevant to such an award, and the record as a whole, the court issues the following order.
Plaintiff filed its complaint on April 28, 1992, alleging among other things that conditions imposed upon it by the State of Georgia violated the Commerce Clause of the United States Constitution by disallowing the importation and disposal of out-of-state waste at plaintiffs landfill.
