(Dissenting.) I am unable to concur in the view expressed by my brethren of the majority.
In the case of Lyon v. City of Elizabeth, 43 N. J. L. 158, cited in the majority opinion, the sheriff levied upon several lots of land owned by the city, by virtue of a writ of fieri facias issued upon a judgment recovered against the city.
