The two actions were in the nature of cross actions, involving the same questions and affecting, in the principles involved, the same parties; and by stipulation they were tried together, and the same proofs used, and one judgment pronounced in both. Cross appeals were taken by the plaintiffs in each action; and by the Mayor, &c., and also by several of the defendants in the second suit. Proper exceptions were taken by the appellants to raise the various questions considered on the appeals.…
