Tbis action was brought by tbe plaintiff in tbe Court below for tbe recovery of $197.86, and was tried upon demurrer to tbe complaint. Tbe plaintiff, a corporation, alleged that, at tbe request of John E. Newsome, Clerk of tbe Superior Court of Hertford County, it became surety on bis official bond, as it was authorized by law to do, in the sum of $15,000 with tbe usual conditions; that said New-some, as Clerk and receiver, by virtue of bis office, received large sums of money to be held by him for several parties and a large part thereof be deposited in bank to bis credit as “Clerk and…
