OPINION

HUSPENI, Judge.

Appellant Donald Peterson was found incompetent to proceed to trial on a criminal indictment charging him with murder in the first degree and was referred to the mental health division of the trial court for commitment proceedings in June, 1986. Appellant was found mentally ill and dangerous in July, and the mental health division refused to re-examine the issue of competency.
