This is an appeal from the Circuit Court of Duval county. After the ease was argued and submitted, the respondent made this motion to dismiss the appeal. .The grounds of the motion, and the facts upon which based, are stated in the opinion of the court. The report of this motion should have preceded the report of the case, the motion having been heard and disposed of before the opinion and judgment upon the appeal was rendered.

The respondent alleges four grounds upon which it is claimed that the appeal in this case, should be dismissed:
