SCHULTZ, Justice.
Ai approximately 11:40 a. m. on February 12, 1979, eighty-year-old Mildred White was found on the floor of the basement garage of her apartment in Sioux City. She stated that she had been assaulted by an armed assailant and that certain items of jewelry had been stolen. Mrs. White was taken by ambulance to St. Joseph’s Hospital, where she died on February 26, 1979. Charges were subsequently filed against defendant, Terrance P. Webb.
