This is an appeal by defendant from an order of the superior court permitting plaintiff to remove the minor child of the parties from the State of California.

' Plaintiff was granted an interlocutory decree of divorce from defendant on November 27, 1939, and the final decree was entered on December 6, 1940. On those dates both parties were residents of California. On April 9, 1944, plaintiff was married to Ben L.
