*1390Appeal, by permission of a Justice of the Appellate Division of the Supreme Court in the Fourth Judicial Department, from an order of the Supreme Court, Onondaga County (John C. Cherundolo, A.J.), entered April 10, 2007 in a proceeding pursuant to CPLR article 78. The order, inter alia, directed the parties to conduct discovery.

It is hereby ordered that the order so appealed from is unanimously reversed on the law without costs and the petition is dismissed.
