Quo Warranto. (1) The fundamental question is: Whether trust companies may receive money in mutuum. By the letter of the statutes they are empowered to receive money in exchange for their credit, thereby establishing the relation of debtor and creditor. This is a quo toarranto proceeding begun by the Attorney-General against The Lincoln Trust Company, Union Trust Company of St. Louis, St. Louis Trust Company, and the Mississippi Valley Trust Company, all of the city of St. Louis to oust them of their franchises, because of the exercise of powers and privileges not conferred upon them by law.
