Defendant, Cecil Watts, was charged in the district court of Texas county with the crime of driving a motor vehicle while under the influence of intoxicating liquor, was tried, convicted and sentenced to serve a term of six months in the State Reformatory at Granite, and has appealed.
For a reversal of this case the following assignments of error are presented:
“1st. The court erred in refusing to sustain the defendant’s demurrer to the evidence at the close of the state’s evidence.
